Terms and Conditions

Please read these Terms carefully before using The Fit Circle website, joining our service or purchasing one of our plans.

1. Who we are

The Fit Circle is a diet, fitness and lifestyle coaching service built for Indians and South East Asians.

The Fit Circle is operated by FITNESSIQ LIMITED, trading as The Fit Circle. FITNESSIQ LIMITED is a private limited company registered in England and Wales under company number 16070207. Our registered office is 58, Marco Polo Bonnet Street, London, England, E16 2AL.

In these Terms, “we”, “us” and “our” means FITNESSIQ LIMITED trading as The Fit Circle. “You” and “your” means the person using our website, joining our service or purchasing one of our plans.

2. What we provide

We provide diet, fitness and lifestyle coaching services.

Our service may include:

  • A personalised diet plan
  • Workout guidance
  • Meal photo review
  • Progress tracking
  • WhatsApp support
  • One to one review calls, depending on your plan
  • Adjustments to your plan based on your progress, routine and feedback
  • Access to a client portal, tracker or digital plan area, where available

Our service is designed to support healthy lifestyle change. It is not a medical service, clinical nutrition service, emergency health service or replacement for professional medical advice.

3. Who our service is for

Our service is intended for people who want support with fat loss, muscle building, fitness, healthy weight gain or general lifestyle improvement.

You must be at least 18 years old to purchase a plan directly from us.

If we allow younger users in future, this will only be with appropriate parental or guardian consent.

4. Health and medical responsibility

You are responsible for deciding whether our service is suitable for you.

Before joining, you must tell us about any health conditions, allergies, injuries, eating disorders, pregnancy, medication or medical advice that may affect your diet, training or lifestyle.

You should speak to a doctor or qualified healthcare professional before starting any diet, exercise or weight management programme if you have any medical condition, injury, concern or doubt.

We do not diagnose, treat, cure or prevent any disease or medical condition. Our guidance should not replace advice from your doctor, registered dietitian, physiotherapist or other qualified healthcare professional.

5. Your information must be accurate

You agree to provide accurate and complete information during onboarding and while using our service.

This includes your age, height, weight, target weight, goal, activity level, dietary preferences, allergies, health conditions and any other relevant information.

If your circumstances change, you must tell us as soon as reasonably possible. This includes changes to medication, injury, pregnancy, medical advice, weight, activity level, eating habits or training ability.

6. Plans and expected results

We build your plan using the information you provide and the information we observe during your check ins.

Your results depend on many factors, including your consistency, food intake, sleep, training, stress, medical history, genetics, lifestyle and adherence to the plan.

We do not guarantee a specific amount of weight loss, muscle gain, body transformation or visible result within a specific timeframe.

Any examples, testimonials or progress stories shown on our website, app, social media or marketing are individual examples only. They do not guarantee that you will achieve the same result.

7. WhatsApp communication

WhatsApp may be used for support, meal photos, check ins and general communication.

You understand that WhatsApp is a third party platform and is not owned or controlled by us.

You agree not to use WhatsApp support for emergency medical issues. If you have a medical emergency, you should contact emergency services immediately.

We aim to respond within the response times linked to your plan, but response times may vary depending on working hours, coach availability, holidays, technical issues or the nature of your request.

8. Your responsibilities

You agree to:

  • Follow your plan safely and sensibly
  • Tell us if something feels painful, unsafe or unsuitable
  • Not ignore medical advice in favour of our guidance
  • Provide honest meal photos and updates
  • Treat our coaches, team members and other clients respectfully
  • Not share your plan, portal access or private materials with others
  • Not copy, resell, distribute or reproduce our content
  • Not use our service for unlawful, abusive or harmful purposes

9. Payments

You must pay the price shown at checkout or agreed with us in writing.

Prices may vary depending on the plan, offer, promotional period or service level.

Payments are processed by our payment provider. We do not store your full card details.

Your plan will only begin once payment has been received, unless we agree otherwise in writing.

10. Subscriptions and monthly plans

If your plan is a monthly subscription, your payment will renew each month unless cancelled in line with these Terms and our Refund and Cancellation Policy.

You are responsible for cancelling before your next billing date if you do not want the next month to renew.

We may change our pricing in future, but any price change will not affect a period you have already paid for.

11. Cancellation rights

If you buy our service online, you may have a legal right to cancel within 14 days from the day after the contract is made.

Because our service often starts quickly after payment, we may ask you to confirm that you want us to begin during the 14 day cancellation period.

If you ask us to start within that period and then cancel, we may charge you for the services already provided up to the point of cancellation.

12. Refunds

Refunds are handled in line with our Refund and Cancellation Policy.

We do not usually provide refunds simply because you did not follow the plan, changed your mind after the service started, did not send check ins, did not use the support available or did not achieve your desired result.

This does not affect your statutory rights.

13. Intellectual property

All plans, documents, trackers, recipes, website content, designs, text, graphics, coaching methods and materials belong to us or are licensed to us.

You may use these materials for your own personal use only.

You must not copy, share, sell, publish, distribute, reproduce, adapt or use our materials for commercial purposes without our written permission.

14. Client photos and testimonials

We will not use your private meal photos, progress photos, screenshots, testimonial, name or image in marketing unless you give us permission.

If you give permission, you can withdraw it later by contacting us. Withdrawal will not affect any use that has already happened before we received your request, but we will stop using the material in future marketing where reasonably possible.

15. Website and portal access

We may provide access to a client portal, website area, app, tracker or digital plan.

You must keep your login details private.

We may suspend or remove access if we believe your account is being misused, shared with others or used in breach of these Terms.

16. Acceptable behaviour

We reserve the right to pause, restrict or end your access if you behave abusively, harass our team, misuse our service, provide false information, share our materials without permission or act in a way that makes it unreasonable for us to continue supporting you.

17. Limitation of liability

Nothing in these Terms limits liability where it would be unlawful to do so.

We are not responsible for losses caused by inaccurate information you provide, failure to follow medical advice, unsafe exercise, misuse of our guidance, third party platforms or circumstances outside our reasonable control.

We are not responsible for indirect losses, loss of income, loss of business, loss of opportunity or loss of data.

18. Changes to our service

We may update, improve or change parts of our service from time to time.

We may also change coaches, communication methods, platform features or plan structures where reasonably necessary.

19. Changes to these Terms

We may update these Terms from time to time.

The latest version will be available on our website. If changes are significant, we will take reasonable steps to let active clients know.

20. Governing law

These Terms are governed by the laws of England and Wales.

Any disputes will be dealt with by the courts of England and Wales, unless consumer law gives you the right to bring a claim elsewhere in the UK.
